Thank you for participating in the LSKD One Month Free Rent Giveaway (the “Giveaway”), conducted by LSKD US, Inc., a Delaware corporation (“LSKD” or “Sponsor”). Your entry signifies your full and unconditional agreement to the following Terms & Conditions. In the event of any dispute, a reasonable interpretation or determination by LSKD regarding the application of these Terms & Conditions is final and binding in all matters related to the Giveaway.

THIS GIVEAWAY IS VALID ONLY IN THE CONTIGUOUS UNITED STATES AND THE DISTRICT OF COLUMBIA. VOID IN ALASKA, HAWAII, FLORIDA, AND NEW YORK, WHERE PROHIBITED BY LAW, AND OUTSIDE THE UNITED STATES.

BY ENTERING INTO OR OTHERWISE PARTICIPATING IN THIS GIVEAWAY, YOU AGREE TO BE BOUND BY THESE TERMS & CONDITIONS AND YOU ACKNOWLEDGE THAT YOU SATISFY ALL ELIGIBILITY REQUIREMENTS. Eligibility.  Open to individual legal residents of the contiguous United States and the District of Columbia (except Alaska, Hawaii, Florida and New York), who are 18 years of age or older (19 years of age in Alabama and Nebraska, and 21 years of age in Mississippi) or the legal age of majority in their state of residence prior to the date of entry. Officers, directors, and employees of Sponsor and its affiliates and their immediate family members are not eligible to participate.

“Immediate family members” includes the spouse, parents, in-laws, grandparents, great-grandparents, brothers, sisters, children, grandchildren, and great-grandchildren of the employee and his/her spouse. This definition also includes individuals for whom an employee is the current legal guardian and individuals who reside in the same house as employee or immediate family member whether or not they are related. (“Step” relationships are also covered by this definition). The determinations of Sponsor are final and binding with respect to any matter arising out of the interpretation or application of these terms and conditions.

An entry by an ineligible person is void. No refunds will be made to ineligible Purchase Method Entrants. Sponsor reserves the right to verify the eligibility of winners.

Entry Period. The Giveaway begins at 12:00:00 a.m. Pacific Time (“PT”) on Wednesady, October 23rd, 2024, and ends at 11:59:59 p.m. PT on Friday November 1st, 2024 (the “Giveaway Entry Period”).

Prize and Approximate Retail Value (“ARV”). One (1) prize of $500 LSKD Gift Card, $100 Blenders Eyewear Gift Card, and a pair of Blenders Limited Edition Keep A Breast Pacer Sunglassses and a pair of Blenders Limited Edition Keep A Breast Mave X2 Sunglassses as determined by Sponsor in its sole and absolute discretion, at the time of award. Each prize will be awarded to only one (1) winner.

Winner Selection Method. The Sponsor will award one (1) prize to an individual who enters the Giveaway by the method described below.

Potential winner(s) will be selected by Sponsor at random from among all eligible entries received on or about Tuesday November 2nd, 2024. Odds of winning depend on the number of eligible entries received. Entrants have an equal chance of winning. If you are a winner, Sponsor will contact you by e-mail and/or phone at the address provided at the time of entry. The name of the winner will be posted on https://us.lskd.co/ on or about Tuesday October 1st, 2024, and any applicable social media platform utilized by LSKD and/or its affiliates, after the prize winner(s) has been verified as an eligible winner. Each prize winner is required to complete and return to Sponsor an Affidavit of Eligibility, Release of Liability and Prize Acceptance Form prior to receiving the prize.

Limit one entry per person and household. Prize(s) will be fulfilled by the Sponsor. Each prize will be awarded “as is” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). If you win a prize, you may not transfer or assign the prize. The Sponsor may substitute a prize with a prize of equal or greater value in its sole and absolute discretion. Sponsor is not responsible for any delay or cancellation of the Prize delivery due to unforeseen circumstances or those outside of Sponsor’s control.

If a winner cannot be contacted by phone or email, fails to accept the prize, or is disqualified for any reason, the prize is forfeited, and no substitute or alternative prize will be provided to such winner. A forfeited prize may be awarded to an alternate winner selected by random drawing.

ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE GIVEAWAY. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.

How to Enter – Entrants may enter the Sweepstakes via the entry method described below. During the Giveaway Entry Period, Entrants agree to opt-in to receive further email communications from the Sponsor. By opting-in, the Entrant thereby grants the Sponsor permission to send him/her future communications regarding services, incentives, offers, promotions, or other messaging related to the Sponsor’s services and products, from which Entrant can unsubscribe from at any time. Normal internet access, phone, and usage charges imposed by your online or phone service carrier may apply. If you are entering via a mobile device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply.

No Purchase Required - Free Online Method of Entry: Internet access required. During the Giveaway, eligible entrants may submit entries without making any kind of purchase or payment, by completing an online form and entering at the Giveaway point of entry (individually referred to herein as an “Alternative Method Entrant” and collectively with a Purchase  Method Entrant, an “Entrant). On the Giveaway entry page, Entrants must confirm they have an eligible U.S. address (Entrant’s may be required to log in to their LSKD account) and follow the entry form instructions. Entries received without a verifiable address will be deemed incomplete and invalid. The Giveaway entry page will specify the Sponsor, prize(s), approximate retail value, how to enter, and the Giveaway Entry Period. Automated or bulk entries or entries submitted by third parties may be disqualified. Entries must be submitted by the participant. No copies, facsimiles, or mechanical reproductions of the entry form will be accepted. Any attempt by any Entrant to obtain more entries by using multiple and/or different identities, forms, registrations, email addresses, logins, or any other methods will disqualify that Entrant’s entries, and that Entrant and/or entries may be disqualified. Multiple Entrants are not permitted to share the same email address. In the event of a dispute as to any entry the authorized account holder of the email address used to enter will be deemed to be the Entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder to the Sponsor or forfeit the prize. Entries specifying an invalid, non-working, or inactive email address will be disqualified. Incomplete, illegible, corrupted, or untimely entries will be disqualified. Each online entry will count as one (1) entry, provided that the entry complies with the above requirements. There is no limit on the number of online entries that an Alternative Method Entrant may submit.

Disclosure in Connection with Publicizing Entry.  Acceptance of a prize constitutes permission for Sponsor to use the winner’s name, picture, video image, and relevant quotes to promote the LSKD Giveaway. By accepting a prize, winner understands and agrees that he/she may be videotaped, recorded and/or photographed as part of awarding such prize. If you choose to promote your entry via social media or other channels, you should disclose your connection to the Giveaway. For example, it may be sufficient to include a statement such as #LSKDGiveaway.

Taxes/Prize Restrictions. Each winner is solely responsible for payment of all federal, state, and/or local income, sales, or use taxes due on account of his or her acceptance of the prize. The value of each prize is includible in the winner’s gross income and may be subject to reporting by Sponsor to the Internal Revenue Service (the “IRS”). Each winner will receive an IRS Form 1099 for the total value of the prize awarded to such winner. A winner’s taxpayer identification number may be required prior to being confirmed as a winner and Sponsor may require a winner to complete and return to Sponsor an IRS Form W-9. If applicable, Sponsor may be required to withhold state tax at the current rate as established by the state in which the Giveaway occurs. Sponsor takes no responsibility for any tax liabilities. Prize winnings must be reported to the IRS when filing your tax returns. Winners should consult a tax professional.

Sponsor will not replace any lost or stolen prizes. A prize cannot be used in conjunction with any other promotion or offer. Only the number of prizes stated in these Terms & Conditions is available to be won in the Giveaway. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Terms & Conditions, an alternate winner will be chosen at random in accordance with the winner selection method described above from among all eligible claimants making purportedly valid claims to award the advertised number of prizes available.  

Release and Limitation of Liability.  The Giveaway is governed by the laws of the United States. By entering the Giveaway, you agree (for yourself and your heirs) that Sponsor and each of its affiliates and agents, and any entity involved in any aspect of the Giveaway (collectively, the “Released Parties”) will have no liability, and will be held harmless from and against liability, loss, injury or damage to property or person, including death, and reasonable attorney’s fees and court costs, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in the Giveaway, even if caused or contributed to by the negligence of any of the Released Parties.

Privacy and Personal Information. By participating in this Giveaway, Entrant consents to the collection, use, and disclosure of your personal information. Information collected from entrants is subject to Sponsor’s Privacy Policy, available at https://us.lskd.co/pages/privacy-policy, and will be used only for the purpose of administering the Giveaway and will not be re-used, sold or shared in any manner, unless Entrant agrees to receive further information on the Sponsor and/or Sponsor’s products and promotions.

Each winner agrees that, by participating in the Giveaway, Sponsor and its affiliates may use the winner’s name in any manner and in any medium for its promotional purposes without additional compensation, including posting in a winner’s list, except where prohibited by law, and Sponsor and its respective affiliates may be required to disclose the winner’s address to state regulatory authorities.

Suspect Entries. If, for any reason, the Giveaway is subjected to infection by computer virus or bugs, tampering, unauthorized intervention, fraud or suspected fraud, technical failures, or any other causes which call into question the fairness or legality of this Giveaway, Sponsor may, in its sole discretion, void any suspect entries and (a) cancel or terminate the Giveaway (or any portion thereof); (b) modify the Giveaway or suspend the Giveaway and then resume the Giveaway in a manner that best conforms to the spirit of these Official Rules; and/or (c) award the prize from among the eligible, non-suspect entries received up to the time of impairment, and all eligible entries received.  

Binding Arbitration.  Each prize winner and LSKD irrevocably agrees and acknowledges that any claim, dispute, controversy or other matter based upon, arising out of or relating to these Terms & Conditions, the Giveaway, or the transactions contemplated hereby or thereby, including (i) as to the existence, validity, enforceability or interpretation of any such claim, (ii) the performance, breach, waiver or termination of any provision in dispute, (iii) any such claim in tort, or (iv) any such claim raising questions of law, in each case, whether arising before or after termination of the Giveaway or these Terms & Conditions, shall be resolved, as between the parties, exclusively and solely by binding arbitration pursuant to the Commercial Arbitration Rules of JAMS, Judicate West, or ADR Services, Inc. (the “Rules”) and in accordance with the following: (a) there shall be a single arbitrator who is selected by LSKD.  The third arbitrator will arbitrate disputes between the Parties; (b) the arbitration shall take place in San Diego County, California and in no other place; (c) the arbitration shall be conducted in accordance with the procedural laws of the U.S. Federal Arbitration Act, to the extent not inconsistent with the Rules or this section; (d) subject to legal privileges, each party shall be entitled to conduct discovery in accordance with the Federal Rules of Civil Procedure; (e) at the arbitration hearing, each party shall be permitted to make written and oral presentations to the arbitrator, to present testimony and written evidence and to examine witnesses; (f) the arbitrator shall have the power to grant temporary or permanent injunctive relief and to order specific performance; (g) prior to the final decision by the arbitrator, the arbitration fees shall be borne proportionally by each party; (h) the prevailing party shall be entitled to an award of reasonable attorneys’ fees and expenses in connection with such claim and the arbitration, and the non-prevailing party shall pay or reimburse the fees and expenses of the arbitrator and of the arbitration service; and (i) the arbitrator shall issue a written decision explaining the bases for the final ruling and which party is the prevailing party, and such decision shall be final and binding on the parties, and not subject to appeal, and enforceable in any court of competent jurisdiction.  For purposes of this section, the “prevailing party” means the party who most substantially achieved its litigation objectives, even if such party did not prevail in all matters.

The provisions of this Dispute Resolution section shall survive conclusion, modification or termination of the Giveaway and suspension, revocation, closure, modification, or amendments to the Terms & Conditions, and any aspect of the relationship of Entrant or the Sponsor relating to or arising from participation in the Giveaway. Entrant agrees that it will not file a class action or collective action against LSKD or its affiliates, and that Entrant will not participate in a class action or collective action against LSKD or its affiliates. Entrant agrees that it will not join its claims to those of any other person.

Severability.  If any provision of these Terms & Conditions is held invalid or unenforceable by any court of competent jurisdiction, the other provisions of these Terms & Conditions shall remain in full force and effect.  Any provision of these Terms & Conditions held invalid or unenforceable only in part or degree shall remain in full force and effect to the extent not held invalid or unenforceable.
