Competition terms and conditions

1. Preliminary
1. This document governs a competition being conducted by LSKD Pty Ltd ACN 123 602 737 of Lot 2, 46 Burchill Street, Loganholme, Queensland (we, us, our).
2. We hold the following permits in relation to the competition:
1. New South Wales: NTP/06312.
2. Australian Capital Territory: ACT TP 23/00499
3. South Australia: T23/385

1. Entrants
1. Eligibility
1. Entry into the competition opens at 10:00:00am (AEST), 01 April 2023, and closes at 11:59:59pm (AEST), 04 May 2023.
2. Entry is free, and is only open to persons who, at the time of entry:
1. are residents of Australia;
2. are aged 18 years or more;
3. have completed, in full, personal information available at our point-of-sale or online check-out; and
4. select the option to offset their transaction using EcoCart.
3. By entering the competition, you warrant that you meet the entry requirements and accept the terms and conditions contained in this document.
4. A person will receive one (1) entry in the competition for each transaction that has the option to offset their transaction using EcoCart and meets all other eligibility requirements.
5. Orders that are returned in full or part for store credit or exchange will still be eligible as entries in the competition. Orders returned for refund will be forfeited as entries in the competition.
6. Our employees (and immediate family members of our employees) are not eligible to enter.
7. We may, in our sole discretion, withhold the prize until the winner provides us with reasonable proof of residency and age.
2. Disqualification
1. We may, in our sole discretion, disqualify the following entries from the competition:
1. Entrants who do not comply with the eligibility requirements specified in clause 2.1(b).
2. Entrants who do not produce reasonable proof of residency or age to our satisfaction (in its sole discretion).
3. Incomplete or incomprehensible entries.
4. Any entrant who we have reason to believe has breached this document, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition.
2. We will not be responsible for lost, late or misdirected entries.
2. Draw (game of chance)
1. We will draw the winner at 11:00am (AEST), 05 May 2023 at Lot 2, 46 Burchill Street, Loganholme, Queensland via electronic barrel draw. The competition does not involve a round in which players are eliminated. Each entry will have a random and equal chance of being drawn.
2. We will notify the winner by email within 24 hours of the draw.
3. We may publish the winner’s name on our website and via our social networks on or before 08-MAY-2023.  Winner will be contacted to confirm all relevant details as close to the draw date/time as possible and once validated that conditions of entry have been met the information will be published.
4. If the winner does not claim the prize within one month after we give them notice, we will redraw a new winner. We will conduct the redraw and notify the winner in accordance with clauses 3(a), 3(b) and 3(c).

1. Prize
1. There will only be one prize for the competition.
2. The prize will be:
1. one (1) 2023 Tesla Model 3 (RWD) black exterior / black interior (approximate retail value AUD$69,741);
2. one (1) Intense Cycles Sniper T Carbon XC Mountain Bike (approximate retail value AUD$6,599); and
3. one (1) removable roof rack, bike carrier and cargo box (approximate retail value AUD$6,599).
3. We will determine all features of the vehicle, including exterior and interior colour and options. The vehicle has been purchased in advance to promote the competition. The vehicle will therefore have a number of kilometres greater than zero along with normal wear and tear associated with normal operation of a motor vehicle.
4. The winner will be solely responsible for all costs and expenses associated with acceptance and use of the prize, including, but not limited to, registration, insurance, and any desired upgrades/options.   
5. The winner will be responsible for travel to us (Lot 2, 46 Burchill Street, Loganholme, Queensland) to collect the prize.
6. We will not be liable for any variation in the prize value.
7. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
8. Accessories, items and other parts, components and personalisation not explicitly included in the itemised prize list is not included in the prize.  This includes but is not limited to personalised registration plates, equipment, accessories or other items that might be featured in the content and promotional material.
2. Privacy
1. In this clause 4, “Personal Information” means information or an opinion about an identified individual, or an individual who is reasonably identifiable:
1. whether the information or opinion is true or not; and
2. whether the information or opinion is recorded in a material form or not.
2. By entering the competition, you agree that we may use or disclose any Personal Information you disclose to us for:
1. the primary purpose of conducting the competition (Primary Purpose);
2. any purpose secondary to the Primary Purpose; and
3. direct marketing by us.
3. We will handle your personal information in accordance with our privacy policy available at https://www.lskd.co/pages/privacy-policy.
3. Liability
1. To the full extent allowed by law, our liability for breach of any term implied into this document by any law is excluded.
2. We will not, under any circumstance, be liable for any indirect, incidental, special or consequential damages or loss of profits.
4. Early cancellation of competition
1. If, for any reason (in our opinion, which is final), we are not able to run the competition as planned, including, but not limited to, infection by a computer virus, bug, tampering, unauthorised intervention, technical failures, security breach or any other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the competition, we may, in our sole discretion, cancel, terminate, modify or suspend the competition subject to any applicable legislation.
2. In the event of war, terrorism, state of emergency, disaster, outbreak, epidemic, pandemic or any other circumstance beyond our control, we may, subject to applicable legislation, cancel, terminate, modify or suspend the competition.
5. General
1. Amendments

We may, in our sole discretion, vary these terms and conditions from time-to-time.

1. Entire agreement

This document contains the entire agreement between the parties about its subject matter. Any previous understanding, agreement, representation or warranty relating to that subject matter is replaced by this document and has no further effect.

1. Jurisdiction
1. This document is governed by the law in force in Queensland, Australia (Jurisdiction).
2. Each party submits to the exclusive jurisdiction of the courts of the Jurisdiction and the courts competent to determine appeals from those courts, in relation to any proceedings that may be brought at any time relating to this document.
3. Each party irrevocably waives any objection it may have now or in the future to the venue of any proceedings where that venue falls within the Jurisdiction.
2. No merger

No right or obligation of any party will merge on completion of any transaction contemplated by this document.

1. Severance

Any provision of this document that is illegal, void or unenforceable is to be severed without prejudice to the balance of the provisions of this document which will remain in force.
